General Assembly Passes Trade Secrets Bill
Dent’s Measure Protects PA Innovations
HARRISBURG -- Senate
Bill 152, a measure introduced by Sen. Charles W. Dent, R-16th District, to
provide trade secret protection for Pennsylvania’s businesses and industries is
headed to the Governor for his signature and enactment into law.
The Senate today concurred on House amendments to SB 152,
legislation also known as the Uniform Trade Secrets Act.
“This legislation will provide Pennsylvania’s courts with a
system to protect the trade secrets of Pennsylvania companies,” Senator Dent
said. “Currently, our courts must use common law to resolve those cases and
that provides an uncertain and ambiguous system for the disposition of trade
secret infringements.”
Under Senator Dent’s bill, a trade secret is any information
(formula, drawing, pattern, compilation, program, device, method, or technique)
having value and which a company makes a reasonable attempt to keep secret.
“To date, 40 or more states have adopted the Uniformed Trade
Secrets Act either in whole or in part,” Senator Dent said. “My legislation
would propose that Pennsylvania join these states and provide this needed
protection for our companies and their innovations.”
